1. I have been arrested. What should I do?
  • Remain calm
  • Remain silent — You do not have to answer any questions the police ask you and anything you say can be used against you in a court of law
  • Be polite and respectful toward the police officer(s)
  • Contact your attorney or ask for one and don't say anything until he or she is present
2. I am being investigated by the police, the FBI, or some other agency. Do I need a lawyer?
It is possible that if any law enforcement agency is asking you about your actions in relation to a criminal investigation that you could become a target in that investigation. You should contact an attorney immediately.
3. I am afraid to talk about my case on the phone. What should I do?

4. I have received a grand jury subpoena to testify. Do I need a lawyer?
If you are served with documents related to a legal proceeding or lawsuit, you should consult an attorney as soon as possible.
5. I have been charged with a misdemeanor. Do I need a lawyer?
It's in your best interest to consult a lawyer as soon as possible if you are arrested or charged with a crime. An Illinois resident convicted of a misdemeanor can face up to a year of jail time.
6. Can my criminal record be expunged or sealed?
Even if a charge has been dismissed or a person has been found not guilty, the arrest will remain on their record until it is expunged. Expungement allows you to permanently vacate a criminal offense from your record. If you have ever been convicted of a criminal offense or a municipal ordinance violation, you cannot expunge any records, regardless of the individual case outcome.

Your records, however, may still be eligible for sealing. Once sealed, your criminal record is kept confidential and can only be reviewed for limited law enforcement and legal purposes. It cannot be shared with potential employers.
